Notice of Appearance

This notice of appearance is a standard template that attorneys, including those admitted pro hac vice, can use to record their appearance in an action pending in New York Supreme Court. A notice of appearance notifies the court and other parties that you represent a party in the litigation. This template contains practical guidance, drafting notes, and alternate clauses. Notices of appearance are typically filed by counsel for defendants who have not previously responded to the complaint or otherwise appeared in the action. However, attorneys recently admitted pro hac vice or joining a case as co-counsel for a party may also file this notice. Filing a notice of appearance is critical to ensure you and your client receive all subsequent notifications and filings in the litigation, including pleadings and motions. Further, per NY CLS Unif Rules, Civil Cts § 202.1(f), "[c]ounsel who appear before the court must be familiar with the case with regard to which they appear and be fully prepared and authorized to discuss and resolve the issues which are scheduled to be the subject of the appearance." If you fail to comply with this rule, such failure may be treated as a default or failure to appear. Therefore, it is important that any counsel appearing in the case are knowledgeable of the facts and issues involved. If your client was previously represented by another attorney, file a substitution of counsel instead of a notice of appearance. See N.Y. C.P.L.R. § 321(b).
